Personal Injury – If you have been injured due to someone else’s negligence, whether the injury results from a poorly maintained premises or negligent disregard of general safety precautions, protecting your health should be your first priority. Protecting your rights should be your next step. An experienced attorney can work with you to ensure you receive the compensation you deserve. When a person is injured by the fault of another person or corporation, the injured is entitled under our system of justice to be fully and fairly compensated.
Medical Malpractice – A medical malpractice action is a civil action in which a patient (the plaintiff) alleges that his or her doctor or other health care provider (the defendant) fell below accepted standards of medical care and thereby caused injury. We are experienced in medical malpractice law and can help clients determine whether or not malpractice has occurred. When some one is injured as a result of negligence or misconduct of a dental or medical professional, a breach of trust has occurred and we help our clients obtain compensation to get on with their lives.
Nursing Home – Our loved ones deserve the best we can offer but occasionally they are victimized by the very people we hire to care for them. All too often, residents of nursing homes suffer through personal injury, either due to negligence or misconduct. The growing number of elderly in our population has, unfortunately, provided our firm with experience in coping with nursing home abuse and neglect.
Products Liability – Products liability refers to the liability of any or all parties along the chain of manufacture of any product for damage caused by that product. This includes the manufacturer of component parts (at the top of the chain), an assembling manufacturer, the wholesaler, and the retail store owner (at the bottom of the chain). Products containing inherent defects that cause harm to a consumer of the product, or someone whom the product was loaned, given, etc., are the subjects of products liability suits. While products are generally thought of as tangible personal property, products liability has stretched that definition to include intangibles (gas), naturals (pets), real estate (house), and writings (navigational charts). Products liability claims can be based on negligence, strict liability, or breach of warranty of fitness depending on the jurisdiction within which the claim is based. Many states have enacted comprehensive products liability statutes.
Motor Vehicle Accidents – Plaintiff – Accidents happen. Sometimes, however, you are injured through no fault of your own. The result can be lost wages, damage to personal property or worse. While you may be injured and in pain you also have to deal with the insurance companies whose desire is to reduce your claim. We have helped many injured victims win rightful and necessary compensation.
Insurance Law – Our clients turn to us when they have claims involving insurance. Remember, the first priority of the insurance company is to reduce your claim. You need a proactive advocate to help you receive the compensation you need. We have years of handling negotiations, settlements, and, if necessary, litigation involving insurance coverage.
Litigation and Appeals – We handle a variety of litigation and appeals. Whether you are seeking compensation from a personal injury or worker’s compensation claim, need a skilled trial attorney to present your commercial civil suit, or need to present your disability case to the Social Security Administration, we have years of trial experience. When clients commence their legal action with us, litigation or settlement are two possible options. We also take on courtroom matters which come to us from other attorneys whose clients need a representative with advanced litigation skills.
Worker’s Compensation – The Worker’s Compensation Law is a no-fault system of social legislation. In general, each state’s Worker’s Compensation law provides disability benefits and medical care for individuals injured in the course of job connected activities. We have represented many clients in the Worker’s Compensation courts of New Jersey since 1984. Worker’s Compensation varies from state to state, but there are many features that are fairly common to a typical worker’s compensation statute.
Social Security Law – Applying for Social Security Disability can be a confusing and complicated experience for many people. Our firm is focused on helping you cut through the red tape to obtain the benefits you worked for and deserve. As your representative, we will provide you with an evaluation of your claim, process all paperwork and applications, obtain medical documentation and reports, prepare you for the hearing, and represent you at the hearing.
Legal Malpractice – As attorneys, we understand the faith and trust our clients place in our efforts to resolve their legal matters. We give each client and their case all our talents and intellect to achieve the best possible result. We expect other attorneys to live up to that standard, but it is not always the case. We have successfully represented clients whose prior attorneys did not act in their best interest.
Commercial Litigation – Commercial matters can be complex and difficult to explain to a jury or judge. Nevertheless, details can make or break your complex business case. We have the ability to present commercial matters, such as contract disputes, in a concise and accurate manner. Regardless of the size of your commercial dispute, the result can affect the future of your business. Don’t leave your livelihood to chance – retain a lawyer with commercial litigation experience to improve your chances of success.
Consumer Protection – Our clients work hard for their money and will not allow themselves to be cheated with bad products or in one-sided business transactions. We have intimate knowledge of the federal and state laws designed to protect consumers and have on many occasions helped clients achieve satisfaction through litigation and alternative dispute resolution.
Employment Law – Employment law covers a complex network of laws that controls how employers must treat employees, former employees, and applicants for employment. Presenting employment law cases requires interpreting and construing state and Federal statutes and case law in areas such as employment discrimination, affirmative action, sexual harassment, employee benefits, whistleblower litigation, wrongful discharge, employment contracts, the Americans With Disabilities Act, the Family Medical Leave Act, the
Worker Adjustment and Retraining Notification Act, the Federal Employer’s Liability Act, the Occupational Safety and Health Act, and special laws governing municipal employment.
